These Terms of Service govern the use of the PHPFixer website and the services provided by Tripleweb Limited (trading as PHPFixer).

These Terms apply once you engage our services or confirm acceptance in writing (including email).

PHPFixer provides PHP maintenance, bug fixing, performance improvements, and related software support and consultancy services.
Services are provided with reasonable skill and care and are tailored to the specific issues presented by each client system.
For the purposes of these Terms, “System” refers to the client’s existing website, application, or PHP-based codebase, including relevant hosting environment, third-party libraries, and external dependencies.
3. Scope limitations
Unless explicitly agreed in writing, our services do not include:
- Hosting, server management, or infrastructure provisioning
- Ongoing uptime guarantees or service level agreements (SLAs)
We focus on targeted fixes, maintenance, and practical improvements to existing systems.
4. No guarantee of uninterrupted or error-free systems
Due to the nature of software systems, particularly legacy or third-party codebases, we do not guarantee that all issues can be fully resolved or that systems will be entirely error-free following our work.
We aim to improve stability, performance, and reliability based on the agreed scope.
5. Client responsibilities
Clients are responsible for:
- Providing accurate and complete information about their systems
- Ensuring appropriate backups are in place before work begins
- Maintaining access credentials and necessary permissions
We are not responsible for data loss where adequate backups have not been provided or maintained by the client.
6. Limitation of liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, or consequential loss
- Our total liability for any claim arising out of our services shall be limited to the amount paid for those services
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.
7. Third-party systems and dependencies
Many systems depend on third-party libraries, hosting environments, and external services.
We are not responsible for failures caused by third-party systems outside our control, though we may assist in diagnosing such issues where appropriate.
8. Pricing and engagement
Any pricing, scope, or engagement terms will be agreed in writing (including email) before work begins.
We reserve the right to decline or discontinue work where systems are unsafe, inaccessible, or outside our expertise.
9. Force majeure
We are not liable for any delay or failure to perform obligations where such delay or failure is caused by events outside our reasonable control. This includes, but is not limited to, server outages, network failures, cyber incidents, or third-party service disruptions.
10. Intellectual property
We do not claim ownership of client code or systems.
Any improvements, fixes, or modifications remain part of the client's system unless otherwise agreed in writing.
11. Website use
You agree not to misuse the PHPFixer website, including attempting to gain unauthorised access, introducing malicious code, or interfering with its operation.
12. Privacy
Our handling of personal data is governed by our Privacy Policy.
13. Changes to these terms
We may update these Terms from time to time. The latest version will always be available on our website.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
